Peg Arguimbau Chairman, Hank Langstroth, Keevin Geller, and Stephen Cremer were the members present.
Elizabeth McGrath arrived at 7:53 p.m. Commission Members, Christine Turnbull and Linda Orel, were absent from the meeting. The Conservation Administrator, Greg Meister, was also present.

7:45 p.m.  RDA Hearing Continuance - Edward Fistel for the proposed addition to an existing single-family house at 132 Ames Street:

Present: The Applicant, Edward Fistel.
             The Applicant’s Architectural Designer, Hagit Levy.

The Applicant’s Architectural Designer, Hagit Levy, appeared before the Commission and submitted a proposed plot plan dated 9/4/12 and architectural drawings entitled, “Fistel Residence, 132 Ames Street, Sharon, MA,” dated 9/4/12. The Applicant submitted the Request for Determination Application form and the architectural drawings of the back and side elevations for his proposed project as previously requested by the Commission.
Hagit Levy explained the following scope of the proposed project to the Commission:
The proposed project includes replacing an existing deck with a 15' 4" x 18' three season porch on the existing 15' 4" x 18' concrete pad. The Applicant's proposed project will not extend beyond the boundaries of the existing concrete pad.
Following the Commission’s review of the Applicant’s proposed project, it was the consensus of the Commission to approve the Applicant’s proposed project.
Peg called for a motion to close the hearing per the Applicant’s submitted proposed plan.
Stephen Cremer moved. Keevin Geller seconded. Voted. Unanimous. 4-0-0.
Peg called for a motion to issue a Negative Determination to the Applicant per submitted proposed plan with the following condition:
Following approval from the Zoning Board of Appeals concerning the proposed project, the Applicant shall contact the Conservation Administrator before starting the proposed work for inspection of erosion  control measures as shown on the submitted proposed plan.  
Hank Langstroth moved. Stephen Cremer seconded. Voted. Unanimous. 4-0-0.

Elizabeth McGrath arrived at 7:53 p.m., following the closing of the above hearing.

8:00 p.m. RDA Public Hearing filed by Mariner Tower II, LLC, for the proposed construction of a cell tower with a gravel access driveway and associated utilities on land owned by the Knollwood Cemetery Corporation off Canton Street:

Chris Ciolfi, from Mariner Tower II, LLC; Glenn Krevosky, from EBT Environmental Consultants, Inc.; and Paul Reed, from AT & T, appeared before the Commission.
Glenn Krevosky submitted a proposed revised plan entitled, “Plan of Land for 000 Canton St., Sharon, MA,” including Sheets T1, A-1 thru A-3, and C-1 thru C-3, dated 8/27/12, (Sheet C-2A, 9/13/12, Last Date Revised), and notification to abutters. The wetland resource areas of the proposed project site were delineated by EBT Environmental Consultants, Inc. The Conservation Administrator, Greg Meister, met with the consultants for the proposed project to review the proposed wetland lines and analyze soils and vegetation of the proposed project site. The Conservation Administrator expressed his concern of an additional wetland system existing on
the site that was coming down from the main wetland resource area of the proposed project site. Additional wetland line delineation was performed by EBT Environmental, Inc., on 9/10/12 that was reviewed and approved at the proposed project site by the Conservation Administrator. The new approved wetland line identified as 1B, 2B, & 3B has been added to the Applicant’s proposed plan as reflected on revised Sheet C-2A submitted to the Commission.

The following is the scope of the Applicant’s proposed project.
The proposed construction of a monopole style cell tower 120'+/- tall.
The proposed construction of a 55' wide x 65' cell tower compound area within the 100' x 100'  proposed project site surrounded by the proposed installation of an 8' high chain link fence.
The proposed project includes an access/utility easement from Canton Street, and the proposed installation of a 440' +/- long x 25' wide access gravel driveway within said easement by Utility Pole # 37. The proposed access driveway will be gated.
The Applicant is meeting with the Zoning Board of Appeals on October 10, 2012 to request a special use permit for installing the proposed underground utilities along the high edge of the roadway to minimize the clearing and to leave more canopy for the proposed project.
All of the Applicant’s activity for the proposed project is being proposed within the compound area and access driveway, away from the 100’ Buffer Zone of the proposed project site.
It was the consensus of the Commission to approve the Applicant’s proposed project.
Peg called for a motion to close the hearing per submitted revised plan.
Stephen Cremer moved. Hank Langstroth seconded. Voted. Unanimous. 5-0-0.
Peg called for a motion to issue a Negative Determination to the Applicant with the following conditions:
The Applicant shall install haybales/siltfence along the approved limit of work area as defined on
the submitted revised plan.
The Applicant shall contact the Conservation Administrator before starting the proposed project
for inspection of erosion control measures.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 5-0-0.

8:15 p.m. A request to re-open the Notice of Intent Public Hearing under DEP File #SE-280-0540 for the proposed solar panel project at 8 and R Commercial Street to accept and review additional information requested by the Commission:

The Applicant was absent from the hearing. The Applicant previously contacted the office of the Commission with a request to re-open the Notice of Intent Hearing to provide additional information to the Commission.
The Applicant is still working on completing a new proposed plan to address a list of concerns of the Commission for the proposed project that will include a new plan for the proposed Conservation Restriction.
The Applicant requested that the Commission continue the hearing until the next Commission meeting.
Peg officially re-opened the hearing and called for a motion to continue the hearing until October 4, 2012 per the Applicant’s request.

8:30 p.m. Approve Past Meeting Minutes:

Peg called for a motion to approve the August 16, 2012 Meeting Minutes as corrected.
Elizabeth McGrath moved. Keevin Geller seconded. Voted. 2-0-3.

Peg called for a motion to approve the September 6, 2012 Meeting Minutes as presented.
Stephen Cremer moved. Keevin Geller seconded. Voted. Unanimous. 5-0-0.

8:35 p.m. Old/New Business:

Update on Eli Blumen’s proposed Eagle Scout Project - Rehabilitating the open space area of Manns Pond:
Peg explained to the Commission that Eli Blumen started working on his proposed Eagle Scout Project of the Mann’s Pond area and that most of the trail clean-up has been completed. Kevin Weber from the DPW and some members of Boy Scout Troop 95 are helping Eli with various aspects of his proposed project. The weed trimming has been completed along the area of Manns Pond. Eli plans to contact Kevin Weber for his assistance in removing the dead trees and limbs that are leaning over the trail areas. A section near Manns Pond has been cleared in preparation for the proposed installation of two granite stone benches. The Sharon DPW has offered
to help move the granite stones for the proposed benches. Eli has also been working with Kurt Buermann, from the Sharon Friends of Conservation, with creating a map of the trail to post on the proposed informational kiosk.

Eli is planning to install safety signs near the over drop by the stone archway on the site.
Eli will report back to the Commission upon completion of his proposed project.

Stephen Cremer reviewed with the Commission, the following observations he has made along Lake Massapoag that may be of concern:

Has the Commission been informed about the last section of pavement work being done on Massapoag Avenue along the east side of Lake Massapoag due to its close proximity of the Lake?
(Peg explained that the Commission has not yet received any notification of the proposed work.)
The large re-construction of a house along Lake Massapoag may have a potential impact on the
subsurface waterflow and other issues in the area. The existing foundation of the house has been
 noticeably expanded.
 (The Conservation Administrator explained that the project has been approved by the ZBA.
This project lies outside of the Commission’s jurisdiction. The construction of the proposed project is away from the 100’ Buffer Zone of the proposed project site.)
The height of the fences along the lakefront areas of Lake Massapoag is an area of concern in addition to being installed in close proximately to the Right-of-Way of Massapoag Avenue.
   (The Conservation Administrator explained that it is not within the Commission’s jurisdiction to restrict  the height of the fences. He discussed this subject with the Building Inspector, Joe Kent, who is also  concerned about this issue and would be in support of a change in the ZBA Regulations.)
                   
Peg suggested for the Commission to discuss drafting a statement of their concerns to send to the ZBA at the October 4, 2012 Commission Meeting.

The Commission signed bills. Negative Determination for the proposed addition to an existing single-family house at 132 Ames Street. Negative Determination for the proposed cell tower on land owned by the Knollwood Cemetery Corporation off Canton Street.
